Private lawyers can exercise notary functions

On 27th March 2017, in Official Gazette N0 13 was published a Ministerial Order Nº

013/MOJ/AG/2017 of 24/02/2017 determining modalities for access to and practice

of the office of notary by private persons, supervision of a private notary and

conservation of authentic deeds.

This Order explains that any person who wishes to be a private notary must fulfill the following requirement:

  • Be a Rwandan national
  • Have attained the age of majority;
  • Hold at least a bachelor’s degree in law or its equivalent;
  • Not having been sentenced, in a final decision ,to a term of imprisonment of more than or equal to six (6) month which has not been nullified by amnesty or rehabilitation;
  • Not having been dis missed from duties as result of disciplinary sanctions;
  • Having at least a five (5) years’ experience in a legal profession.
