- 2007 Achievements
In the past, the Ministry embarked on a major legal reform targeting the justice sector cluster with the view to achieve effective and efficient delivery of legal services to Rwandans. Some of the major achievements are:
•Most obsolete laws have been repealed to be consistent with the new Constitution. Obviously this process is not an accomplished one but it is still a going concern. Additionally, new and modern laws have been put in place to address present challenges;
•Old and major commercial laws have been repealed. Additionally, a law establishing commercial courts has been passed and soon the courts shall be functional adjudicating over only commercial matters. It is hoped once functional, commercial courts shall facilitate investment and build investor confidence;
•Many International and Regional agreements have been signed by the Government and the Ministry facilitated their ratification;
•The Ministry was at the forefront advocating for the abolition of the death penalty. To this end, the death penalty has been abolished and removed from the Rwandan Penal Code. The abolition of the death penalty was found inevitable given the Government’s commitment to protect the fundamental right to life and the desire to promote reconciliation among the Rwandans.
•It was this ingenious act by the Government of Rwanda that His Excellency the President was recently received the Annual “Abolitionist of the Year Award 2007” by the Hands off Cain (HOC) Organization;
•The Supreme Court which is administratively autonomous from the Ministry of Justice was established. This was in line with the requirements of the new Constitution;
•The National Prosecution Service which is administratively autonomous from the Ministry of Justice was established in accordance with the Constitution;
•It is now a norm that only Law Graduates are employed by Government as Judges, Magistrates and Prosecutors unlike before.
