1.IMPROVE THE QUALITY IN STATE REPRESENTATION
Improved State representation before the courts
- 280 of 300 Cases either 93.3% have been dealt with ;
- 60% claims in connection with damages causes to Government by public servants were lodged to court;
- 27 cases executed equivalent to 114.718.439 Rwf
- Reduce backlogs of settlements out of Courts concerning State litigation 7 Cases settled out of courts equivalent to 206.771.934Rwf The advice on 127 government contracts and international instruments was provided including
- 55 international instruments;
- 46 government and private contracts;
- 26 contracts of Ministry of Justice
- 92 of other documents addressed to MINIJUST were advised too.
2.IMPROVEMENT IN LEGAL ADVICE PROVIDED TO THE GOVERNMENT
1.Legal advice on contracts and other documents addressed to MINIJUST improved 2.models contracts have been prepared which need to be finalized: a contract for privatization and a Joint Venture Agreement
3.IMPROVEMENT IN THE QUALITY AND HARMONY OF EXISTING AND NEW LAWS Improved coordination of the drafting of National Legislation
- Draft of law relating to persons and family;
- Draft of law relating to succession;
- 6 drafts of laws on judiciary;
- 4 drafts of laws on prosecution;
- Draft of law relating to bailiffs;
- Draft of law relating to bailiffs;
- Organic Law on Abunzi;
- Presidential Order relating to Abunzi election;
- Draft of law on “Regional Arbitration Centre”
- Draft of law on extradition (Abunzi law was amended and published in OG of the Republic of Rwanda);
- Organic law on Public Institutions (Published in OG) ;
- The Draft Law on persons and family was sent to Parliament;
Establish a National Legal information center
- The draft was sent to the Cabinet and they recommended further consultations. Establish and support the National Law Reform Commission Organic Law establishing National Law Reform Commission was published on 12/07/2010
4.PROMOTE RULE OF LAW, HUMAN RIGHTS AND LEGAL AID Increased efficiency in the Justice system
- 30 Maisons d’Accès à la Justice / Access to Justice Bureaus (MAJs) have been established in all 30 Districts of Rwanda
- A training of civil Registrars were held
- A training of the conciliators committees were also held
Improve the execution of judgments
- The number of professional bailiffs was increased so as to speed up the execution of judgments
- Advocate on the importance of civil registration statistics at 416 sectors level
- The training of civil legislators was provided
- The level of respect of human right increase
- Three reports were produced related to international treaties PIDESC1, CDR2, CADHP3, approved by the cabinet and submitted to relevant international bodies in 47th Assembly held in Banjul in May 2010.
- The draft report on the Rwandan commitment for human and people right issues(universal Periodic Review) was prepared by the Ministry of Justice in collaboration with the Ministry of Foreign Affairs to be submitted to the concern institutions after the cabinet’s approval in October 2010
- In collaboration with MINAFFET the list of international treaties to be ratified was prepared.
- A documentary film is broadcasted on RTV to sensitize the Rwandan on Child and Gender Based Violence
- Leaflets were distributed throughout the country to sensitize the Rwandan about guaranteed to them by the law in the judicial institution
- 5 sports were broadcasted on radio Rwanda to sensitize the Rwandan to know what the law requires when they need legal advice and their right when they need the legal advice
5. ARCHIVE ALL OLD FILES
- All laws were published in Official Gazettes database WINISIS,
- All Official Gazettes for year 2009 are compiled
